I think my oil filter gasket is leaking. what should this cost at a indy? any diy to follow???

What's your mileage?
Bavauto has some insight into this (http://blog.bavauto.com/1141/bmw-m54-6-cylinder-engine-oil-leak/) and also mentions an alternate source of oil leakage in that area.
I haven't had to deal with that but for future reference, I have a DIY bookmarked (http://forum.e46fanatics.com/showthread.php?t=534524) with a note to see post #16.

Definitely do this yourself if you can. It doesn't look very difficult at all and you can save yourself some dough.

SES light is probably unrelated to oil leak.
Easiest thing you can check re SES is to make sure your gas tank cap is on tight.

I think the part you're looking for is the large O-ring, part # 11421741000, about $5. just unscrew the filter housing and replace the o ring, just make sure to smear some clean oil on the new part before you seal the housing back up

Nope. Not the oring. The gasket.
Oring should come with filter.

A number of things, but typically a vacuum leak.
Lower intake boot is a good place to start your search (specifically the elbow).

Well bad news didn't find leak yet and now I lose a shit load of power at highway speeds I can't go past 2.5k rpm. I checked under hood and as u give throttle u can hear a whooshing sound from intake

You actually need to take airbox out, upper and lower intake boots and inspect them for leaks.

found the sourse of the leak, i dont know the exact part number but i will post a pic today after class. this was found at roughly 1130pm last night. i refused to sleep until i found it!

Was it on a rubber piece or was it a gasket?

Dane it's a rubber piece. If you follow the intake tube down there is a hose that extends from the left side of the tube and goes towards the engine. It's a rubber hose and it is cracked
