^....no...I do not think that was the case. I think they simply wanted me to ask their permission first, to even put the thread on their forum. Stupid if you ask me. Me and Mike stand to make zero money from this and simply wanted to offer the guys some cool..custom products...since I had done business with Mike before.

So...yeah....I PM Kevlar yesterday and ask him whats up. He says that this other guy is on vacation....so I will have to wait till he gets back. Not happy....as this was only for the guys on the forum, and would have only brought more publicity to his forum. I don't get it. I hadn't even really planned to get anything for myself.
Still in a hold pattern. The thread with the orders are still there.

I don't know what happened. I had the thread up there for like 3 weeks.....and all of sudden it got removed. I inquired and they said I "hadn't gotten permission yet"
You know.....the permission I would need to "help members" on the site. I was not doing it for profit, and neither was scrnprntr. I only started the thread, because DJ Syco wanted a Beenie, and I thought I would see If I could get whatever people wanted. We didn't want to infringe on "copyright" so we decided to go with the E46 logo.....
the items we were sellin were..
Pretty simple stuff really....just something to shoe off your E46 pride....

DW, you may have a trademark issue there. I would be surprised if E46 is not a registered trademark of BMW AG. As a result, you need a license from BMW to be able to use those marks in commerce. It's possible that BMW contacted Bf.c. Not sure, though. I don't know what happened.
BMW wants to control its marks. It does not want the buying public to think that it is getting BMW-approved, or manufactured, gear from them -- when it is not. That's why BMW licenses its marks and makes sure that it signs off on the quality.

That is not the reason Bf.c took it off their site. Good point though. The only trademark issue I think we would have is if we used the roundel. Hey....wait a second. Isn't the roundel a trademarked symbol? How would we use it here then?
Did you have to get permission from BMW NA?
How would I use it in my avatar....etc.?

There are several tests, Dane, that go into trademark infringement.
At the core, trademark holders are worried about people being confused about the source, origin, or sponsorship of a product that has the mark on it. No such worry here about that. No one would confuse this site as being affiliated with BMW. Moreover, no one would think that the source of this site has anything to do with BMW AG. Ditto the origin.
The better argument that BMW could make -- and this is the catch-all argument that trademark holders use -- is that I am diluting their mark (I'm using their mark and I'm using it -- tangentially -- in commerce). Dilution itself is the injury that BMW cites when it makes this argument. There is an 8-factor test to determine dilution under the anti-dillution statute.
My guess is that BMW would have less issue with me and my use of its mark and a LOT more issue with the E46 merchandise that someone is trying to sell. Consumers would be more likely to think that the E46 merchandise is coming from BMW. Consumers, even if they knew that the product was made by someone other than BMW, might still think that the merchandise is authorized by BMW.
The E46 merchandise is exactly the kind of trademark infringement that BMW looks for.
