So today I was driving in the right lane and going 45 which is the speed limit on the road . Then all of a sudden a girl in a nissan rouge merged right into the side of my poor baby.

Side moulding , rear bumper over haul, bottom skirt , and repaint the whole side , and re do the door.

Got estimates today , both prices are very close, hope to get it in the shop early so I can get my baby back.

Well the girls father is not wanting to pay after he found out the price , so now my dad is probably going to file it on his insurance now.

Damn, sorry to hear. Make sure your body shop does a good job on paint, because bad color matching is especially noticeable on gray.

Understandable that he doesn't want to pay out of pocket, but this should be paid by the girl's/girl's father's insurance - not yours. If anything your insurance will act as a middle man to deal with their insurance. She was at fault therefore they have to pay for the repairs

Well see what happened was that we agreed not to call the cops and make them swap the insurance and the girls father would pay out of pocket for it so it doesn't go against their insurance. But now when we call him he starts to act stupid and doesn't want to pay out of pocket so now either we get him to pay or my dad pays for it himself.

Yeah but my dad would rather pay just incase the insurance says we have to fix each other's cars , and then that will make my insurance skyrocket

Yeah this is pretty black and white, goon. She was at fault, her insurance should cover. You should be out of pocket $0 and your insurance should be unaffected.

I know you were trying to be nice and deal with the offender in good faith at the time of the accident, but you should always call the cops to get an official accident report. Now technically she could say you hit her and refuse to cooperate.

My nephew was involved in an accident last year here in Austin Tx. He was not at fault. Both drivers agreed to call the cops right there in the spot to file a report. The operator said since the accident was minor, the police weren't going to show. Instead, she asked my nephew to report this online. He had 3 days (I believe) to file the report online. But a big difference here is the other driver was cooperative from beginning to end.

Since you are in Houston Tx maybe a similar report can be filed there. Check with 311 (if available).

Police report is not nessc to make a claim against her insc. You can call her insc directly and make a claim against her. I did this one time when I got hit at a red light.

I did this in my recent accident as well.

Just give her information to your insurance company and tell will deal with it.

Its nice to just sit back and wait for a check.

And this kind of stupid run-around bullshit is why I always call the cops if I'm in an accident.

Yeah , never again my dad said now , we were trying to be nice so the girl didn't get it all on her insurance because she barley got her license.
